Many animals have helped humans in many ways since the past. And the various qualities of animals show that we should treat them as more than simple things. This is the same for military animals. Nowrot and Gunkel note that, under international law, military animals are treated as military equipment. Nowrot and Gunkel explain that military animals are something more than military equipment, and they believe that military animals should be treated properly. Furthermore, they argue that they should acquire the status of combatants. This paper acknowledges that military animals should have higher legal and moral status than they do now, but argues that they cannot have the status of combatants. This is because animals cannot fulfill the obligations necessary to be recognized as combatants. If ignoring this issue, it could result in additional problems. This paper will explain how combatants and their rights are secured in the just war theory, and show that Nowrot and Gunkel's arguments fail from the perspective of just war theory.
